This Privacy Policy (“Privacy Policy”) describes how we use, collect, process, and share information obtained through the website at “Site”).


As a small business that sells and operates online, we believe that our customers’ privacy is of the utmost importance. We want you to have complete access to our policies and procedures, so that you may understand the ways you can control how we collect, use, and disclose your personal information.


What information do we collect?

We also automatically receive your computer’s device ID (“Device ID” means an ID that is unique to the device or browser on which you access our Site), internet protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and date/time stamp for your visit. This helps us know more about your browser and operating system. You may, however, visit our site anonymously.


Do we use “Cookies”?
Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. When you place orders or access your personal information, we offer the use of a secure server. All sensitive information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be only accessed as stated above. Credit card payment is processed through Stripe. All credit card information is stored and encrypted in Stripe’s PCI DSS Level 1 Service Provider compliant server. Do we disclose the information we collect to third parties?
‍We do not sell, trade, or otherwise transfer to third parties your Personal Data unless we provide you with advance notice, except as otherwise described below. The term “third parties” does not include our business. It also does not include website hosting partners and other parties who assist us in operating our Site (i.e., currently, our platform is “powered by” WooCommerce to analyze data, process transactions, and payments, and fulfill orders), conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our Site policies, or protect ours or others’ rights, property, or safety.

Third Party Tracking Companies. We use a tool called “Fathom” to collect information about use of our Sites. Fathom anonymously collects information such as how often users visit the Sites, what pages they visit when they visit, and what other sites they used prior to coming to our Sites. We use the information we get from Fathom only to improve the Site. Fathom generates a Random IP address that is anonymously assigned to you during your visit. Keeping your privacy at the forefront. ‍Social Networks. If you use any features made available to you on our Site by a third party (i.e, Instagram, Pinterest, Facebook, Twitter) it may result in information being collected or shared between us and the third party. For example, if you use Facebook’s “Like” feature, Facebook may register the fact that you “liked” a product and may post that information on Facebook.

Other Third-Party Service Providers. We may share your Personal Data with companies that perform services for us, such as fulfilling orders, delivering packages, sending postal mail and e-mails, analyzing customer data, providing marketing assistance, processing credit card payments, investigating fraudulent activity, conducting customer surveys, and providing customer service. We share email activity data with Mailchimp to help us with automated email deployments to consumers for order confirmations, status updates, abandoned cart emails or product review survey emails. While Mailchimp has a license from us to use e-mail addresses and e-mail activity data in their applications, these applications do not share email addresses or any specific email activity data with other third parties that are not our service providers.


You can make the following choices regarding your Personal Data:

‍Promotional Emails. You may choose to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials related to Incaliving. You can opt out of receiving these emails at any time by following the instructions in the email or by contacting us directly at [email protected]. If you decide not to receive promotional emails, we may still send you service and transaction related communications.

Changes To Your Personal Data. Incaliving relies on you to update and correct your Personal Data. You can modify or delete your profile within your registered account. Please note that Incaliving may keep historical information and content in our backup files and archives as permitted by law and to the extent we anticipate that the information may be required in connection with the original purpose of the collection, or as otherwise permitted or required by law or our legitimate interest to comply with foreign law.

‍Deletion Of Your Personal Data. Typically, we retain your Personal Data for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required for the operation of purchase transaction or permitted by law or our legitimate interest to comply with foreign law. You can, however, request that we delete your Personal Data. All requests must be directed to the contact in the “Contact Us” section below. We can also decide to delete your data at any time if we believe that the data is incomplete, inaccurate, or that our continued use and storage are contrary to our obligations to other individuals or third parties. Request Verification
Before we can respond to any CCPA requests, we will need to verify that you are the consumer who is the subject of the CCPA request. Verification is important for preventing fraudulent requests and identity theft.

The verification process depends on which type of request you make and how you make it. Typically, identity verification will require you to confirm certain information about yourself based on information we have already collected. For example, we will ask you to verify that you have access to the email address we have on file for you. If we cannot verify your identity based on our records, we cannot fulfill your CCPA request.

For a request that seeks specific personal information, we ask that you sign a declaration stating that you are the consumer whose personal information is the subject of the request, as required by the CCPA.

In some cases, we may have no reasonable method by which we can verify a consumer’s identity. For example:
• If a consumer submits a request but we have not collected any personal information about that consumer, we cannot verify the request.
• If the only data we have collected about a consumer is gathered through website cookies (i.e., the consumer visited our website but had no other interaction with us), we are unable to reasonably associate a requester with any data collected; therefore, we cannot verify the request.


A California resident’s authorized agent may submit a Request to Know or a Request to Delete under the CCPA by emailing us at [email protected] . Requests submitted by an authorized agent will still require verification of the person who is the subject of the request in accordance with the process described above. We will also ask for proof that the person who is the subject of the request authorized an agent to submit a privacy request on their behalf. An authorized agent that has power of attorney pursuant to California Probate Code section 4121 to 4130 must submit proof of statutory power of attorney, but consumer verification is not required.
